Determination of Rent and Eviction Procedures
Rent determination and eviction claims arise from tenancy relationships but are governed by different legal grounds and procedural rules under Turkish tenancy law.

In residential and roofed workplace tenancies, renewal rental adjustments are governed by the Turkish Code of Obligations. Contractual indexation differs from judicial rent determination. In leases exceeding five years or renewed thereafter, statutory rules require evaluating equitable market benchmarks and property characteristics.
Eviction requests require specific statutory grounds. Residential or workplace necessity, reconstruction, acquisition by a new owner or written eviction commitments each carry distinct prerequisites and timeframes. Contract expiration alone does not automatically yield eviction.
Most tenancy disputes now require statutory mediation prior to filing an action. Careful factual review of agreements, payments, written notices and commitments is essential. (Source: TCO Arts. 344-345, 350-352, Law No. 6325 Art. 18/B).
